The day after Attorney General Bill Lockyer granted twelve Pacifica station listener-sponsors "Relator" standing to sue, the "Relators" filed their lawsuit in Alameda County Superior Court on behalf of listeners across the country and the public interest. This comes after a year-long grassroots effort by The Committee to Remove the Pacifica Board, supported by declarations from more than 3,500 listeners, to gain standing to sue for breach of the Pacifica Foundation trust by its directors. NorthBay for KPFA member Gary Evans flew to the board meeting in Virginia and personally served the Summons and Complaint on Mary Frances Berry and the 11 other board members present on September 17th. This suit seeks removal of the board Executive Committee for gross abuse and breach of trust, and seeks damages against them for the unauthorized expenses connected to the KPFA lockout. The suit also seeks removal of all directors illegally elected since last October, and bylaws revisions setting up a fair and reasonable governance structure for Pacifica, granting legal "membership" status and voting rights to listener-sponsors. The listeners plan to move swiftly to demand documents production and other discovery of the Pacifica Board in early October, with depositions to follow. DIRECTORS’ LAWSUIT FILED ON 9/19

Following right behind the listeners, Pacifica Directors Rob Robinson (WPFW) and Aaron Kriegel (KPFK) filed suit in Alameda County Superior Court on Tuesday right after the board meeting. This suit also alleges illegal operations by the Pacifica board and asks for removal of the Executive Committee, as well as restoration of the LABs’ rights to elect directors. The Folio congratulates Robinson & Kriegel and hopes that other "dissident" directors - Bramson, Moran, Cagan and Lyons - will join Robinson & Kriegel’s lawsuit rather than permitting answers to be filed in their names, along with the other directors, denying all wrongdoing at Pacifica.
